1. STANDARD RENTAL RATES INCLUDE:

1.1 Unlimited kilometres

1.5 Airport transfers to a maximum of 50km from the Windhoek Airport to the AVIS Safari Rental Branch in Windhoek, Namibia.
1.6 Johannesburg/Cape Town transfers between branch/depot within a 10km radius
1.7 All applicable taxes
1.8 Introduction to the vehicle and equipment

2. OPTIONAL ADDITIONAL SERVICES possibly via 3rd party service provider:

2.1 Route planning and booking assistance via third party service provider
2.2 Guided Tours via third party service provider

3. MINIMUM RENTAL DURATION AND COSTINGS:

3.1 Minimum rental period is 7 (Seven) days at any of the collection points listed below. Any other prior arranged pick-up points, minimum of 15 (Fifteen) days.
3.2 The day of pick up and drop off are counted as full days irrespective of the time collected or returned.
3.3 No refunds are applicable for early returns unless arranged in advance and agreed by Avis Safari Rental.
3.4 Late or delayed arrivals – should Avis Safari Rental incur additional costs whilst collecting or delivering vehicles at out stations due to The Renter late arrival, they will be for the The Renter account.

4. OFFICE HOURS

4.1 08H00 TO 16H30 Monday to Friday.
4.2 Deliveries and collections are included from Monday to Friday during normal office hours, after hours, on Saturdays and Sundays or public holidays there will be a surcharge fee of R850.00 per vehicle.
4.3 The agent or The Renter must arrange a collection point and time with Avis Safari Rental reservations at least one week before rental collection and provide a working cellular number for the renter.
4.4 No vehicle may be returned at any airport – it must be termed at a depot.

NB: To ensure timeous vehicle return The Renter must arrange the return with the respective branch 24hrs before return. Collection delivery points other than Cape Town and Windhoek are managed out of the Johannesburg depot.

5. USAGE:

5.1 The Renter acknowledges that he/she is aware of the purpose for which the vehicle was designed, as well as all safety and maintenance procedures. The Renter is responsible to look after and maintain the vehicle during use and to return the vehicle in good order, fair wear and tear accepted.
5.2 In the event of the vehicle or any of its belongings being lost or damaged during the rental period, the Renter shall be liable to cover the cost of replacement or repair and to make good on any shortages or damages to the vehicle. Waiver cover is included and will cover loss or damage due to theft and collision damages, but not to lost or damaged equipment due to carelessness or negligence.
5.3 Cross border travel – written authorization is required for any travel outside of South Africa at an additional fee.
Avis Safari Rentals are not responsible for adhoc fines, levies or other extraordinary expenditure that may occur in countries outside of South Africa
The Renter is responsible to acquire and ensure;
All vehicle travel documentation to countries outside of South Africa is valid for a minimum of 14 days after rental termination date – failure to do so will result in the respective country penalty being charged to the Renter’s account.
5.4 Checking the vehicle and signing the contract – it is recommended that the Renter should check the vehicle thoroughly on handover to ensure the vehicle meets with their requirements and it is always beneficial to recheck items like wheel changing tools and tyre condition. On signing the contract, the Renter signs acceptance of the vehicle and equipment.

6. REPAIRS, MECHANICAL FAILURES AND RUNNING CHARGES

6.1 Any mechanical repair or replacement related to fair wear and tear is covered by Avis Safari Rental. Repairs of up to ZAR 3000.00 can be effected without prior authorization. On higher amounts prior authorization is required from Avis Safari Rental. Due to the vastness of the area where vehicles are mobile the Renter is responsible to get the vehicle to the nearest workshop. Where not mobile the vehicle should be towed to the nearest workshop for diagnosis.
6.2 In most cases vehicles are still covered under the new vehicle manufacturers warranty and their warranty conditions will apply where mechanical failures occur. It is important to remember that Avis Safari Rental is not the manufacturer of the vehicle or equipment but will do its utmost to select and offer the best and most recommended vehicles and equipment as well as ensure the vehicles are fully maintained and checked prior to departure.
6.3 Where serious mechanical failures occur due to standard wear and tear and which cannot be repaired timeously a replacement vehicle will be supplied within 24 hours of diagnosis. This relates to the countries of South Africa, Botswana, and Namibia. The replacement time in the following countries will be 72 hours Zimbabwe, Southern Mozambique and Southern Zambia.
6.4 Inconvenience and time lost is not covered for mechanical failures which cannot be anticipated.
6.5 Towing is covered in the waiver for the countries of South Africa, Botswana, Namibia, other countries like Zimbabwe, Southern Mozambique and Southern Zambia towing is covered by the Renter.
6.6 A ZAR 30 000 refundable security deposit will be charged to the Renter’s credit card on vehicle collection. Avis Safari Rental will not be held responsible for currency fluctuations.
6.7 The Renter must fully refuel the vehicle no more than 10km radius from drop off point – Avis Safari Rental reserves the right to confirm the fuel level by way of refill.
NB: Avis Safari Vehicles are fitted with Long Range tanks therefore the fuel gauge showing full does not constitute a full tank – Avis Safari will top up each vehicle on return.
6.8 A ZAR 800 cleaning fee is charged for the Renters account upon return of the vehicle. This is a standard fee charged to all customers for cleaning the exterior and interior of the vehicle as well as the linen, crockery and cutlery. In the event that the vehicle is returned in an extremely dirty condition, it will be cleaned by a professional valet service and the cost of the valet will be charged to the Renter.

7. VEHICLE MAINTENANCE REQUIREMENTS

7.1 The vehicles are all fully serviced and maintained as per manufacturers requirements and Avis Safari Rental has introduced additional maintenance which is completed on vehicles.
7.2 The Renter is responsible to maintain the vehicle during the rental period. This includes the standard check of tyre pressure, wheel nuts, wheel alignment if necessary, oil and coolant levels and to be aware of any symptoms which may arise during the rental period. In addition, should the vehicle reach 15 000 kilometres (10 000 km for Land Cruiser) intervals (see Annexure:2) during the rental period, the Renter is required to service the vehicle at a suitable workshop associated to the vehicle manufacturer. Where an official dealer is not available, other workshops may service the vehicle with our authorization. The schedule service charges and any other repairs related to standard wear and tear on the vehicle will be covered by Avis Safari Rental.
7.3 Avis Safari Rental vehicles are under maintenance plan therefore the Renter will be reimbursed at rental reconciliation.

8. COLLISION DAMAGES AND ACCIDENTS

8.1 All accidents must be reported to the local police within 24 hours.
8.2 Where collision damages render a vehicle unusable, a replacement vehicle can be supplied by Avis Safari Rental if available. All costs will be for the Renter’s account if the Renter took out Standard Waiver Cover.
8.3 The Renter is responsible for the return of the damaged vehicle to the original office if outside of the borders of South Africa.
8.4 No refund will be given for lost days due to collision damages.
8.5 Should the Renter continue with a new replacement vehicle, a new rental contract and Standard waiver conditions will apply.
8.6 The exact waiver conditions and area of liability will also depend on the level of waiver selected.

9. WAIVER AND WAIVER EXCLUSIONS

9.1 The Renter is obliged to accept cover from the Company in respect of a Waiver Protection Package and can elect between STANDARD WAIVER or SUPER WAIVER as contained in the Rental Agreement. All vehicles hired from the Company are hired subject to acceptance of a minimum of the compulsory STANDARD WAIVER option.
The Damage Liability Amount applicable to the STANDARD or SUPER WAIVER respectively is contained on the front page of the Rental Agreement for the Rental Period and is subject to the Terms and Conditions of this Rental Agreement.
The Renter shall be liable for any and all loss/damage of, or to the Vehicle sustained by the Company, arising from any cause whatsoever, subject to the Damage Liability Amount payable, as described in the front page of the Rental Agreement, where applicable.
The renter will, subject to clauses 9.5 and 9.6, be liable for the damage liability amount applicable irrespective of the manner in which an incident occurred or whether the damage was due to negligence by a third party.
In the event of the Vehicle being stolen or considered beyond economical repair; the replacement value will be the retail value as contained in the Auto Dealers Guide as at the time of such loss. In the event of the Vehicle being less than (1) one-year-old, the cost thereof shall be the retail value of a new vehicle. All accessories, spares, equipment and tools, irrespective of the age of the Vehicle, will be replaced as new.
Any breach of the terms and conditions contained in this Rental Agreement:
may result in the Company withholding a replacement vehicle from the Renter; this election is at the sole discretion of the Company; and
will result in the Renter being deemed fully liable for all damages to the Vehicle.
Notwithstanding anything in this Rental Agreement, the Company shall not be obliged to make, institute or proceed with any claim which the Company may otherwise have had against a third party for the recovery of any loss or damage to or in connection with the Vehicle and accordingly, the Company shall be entitled, in its fair and reasonable discretion, to abandon such claim or to settle such claim on any terms.

9.2 Standard Waiver cover, is included on all vehicles and in all rates quoted. This is NOT full cover and a ZAR 30, 000.00 excess is applicable, the monetary value of which depends on the vehicle category. The excess is payable for any damage, irrespective of the cause of such.
9.3 Waiver cover is valid in the following countries; South Africa, Botswana, Namibia, Zambia, Zimbabwe, Mozambique, Swaziland, Lesotho. Special permission is required for any other countries in Sub Saharan Africa.
9.4 Third party cover: the standard waiver cover includes third party cover for RSA, Namibia, Botswana, Swaziland and Lesotho only. Third party cover for any other country must be purchased at the port of entry.

9.5 STANDARD WAIVER

Upon acceptance of the Standard Waiver for collision, damage or theft, the Renter agrees to pay the Damage Liability Amount (ZAR 30, 000.00) applicable in respect of any damage and/or loss suffered from any cause whatsoever, including hail damage, subject to the following exclusions, in which event the Renter will be held liable in full for payment of all damages in terms of this Rental Agreement: –

(a) Gross Negligence, including speeding (Exceeding the applicable speed limit) ;
(b) Where damage was caused to upholstery and/or carpets;
(c) Where damage and/or loss is sustained to tyres and/or rims and/or hubcaps and or glass/auto-glass of the Vehicle;
(d) In the event of a collision and/or loss of the Vehicle which is not reported within twenty-four (24) hours as required;
(e) Where the Vehicle was driven in or to a country and/or area, for which prior written approval was not obtained from the Company;
(f) Where a non-designated driver or drivers have caused the loss and/or damage;
(g) Where the damage/loss is sustained as a result of civil unrest, riot, war or political unrest;
(h) Where the damage/loss is sustained by water and under-carriage or suspension damage or either;
(i) Where the damage/loss is caused by driver fatigue or falling asleep behind the wheel;
(j) Unauthorised salvage and/or towing and/or release fees;
(k) Contravention or breach of any term of this Rental Agreement by Renter or Additional Driver;
(l) Single vehicle roll-over. A roll over is defined as a vehicle sustaining all types of damage due to it not being on all 4 wheels; (the vehicle being on its side is construed as a roll over) Single vehicle accidents are included in all liability cover options, except in the case of roll-overs.
(m) Double standard excess apply to single vehicle accidents. Standard cover excess = ZAR 30, 000.00 x 2 = ZAR 60, 000.00 (Repairs less than ZAR 60, 000.00 will be refunded)
(n) Damage caused to equipment such as Canopy, Rooftop tents, Awnings and Fridges.

9.6 SUPER WAIVER

Upon acceptance of the Super Waiver for collision damage or theft, a holding deposit of R4000.00 will be taken to ensure the vehicle is returned on time and returned with a full tank of fuel. The renter will pay a ZAR 0.00 (Zero) Damage Liability Amount applicable in respect of any damage and/or loss suffered from any cause whatsoever, including hail damage, subject to the following exclusions, in which event he will be held liable in full for payment of all damages in terms of the Rental Agreement for payment in terms of this agreement;-

(a) Gross Negligence, including speeding (Exceeding the applicable speed limit) ;
(b) Where damage was caused to upholstery and/or carpets;
(c) In the event of a collision and/or loss of the Vehicle which is not reported within twenty-four (24) hours as required;
(e) Where the Vehicle was driven in or to a country and/or area, for which prior written approval was not obtained from the Company;
(f) Where a non-designated driver or drivers have caused the loss and/or damage;
(g) Where the damage/loss is sustained as a result of civil unrest, riot, war or political unrest;
(h) Where the damage/loss is sustained by water and under-carriage or suspension damage or either;
(i) Where the damage/loss is caused by driver fatigue or falling asleep behind the wheel;
(j) Unauthorized salvage and/or towing and/or release fees;
(k) Contravention or breach of any term of this Rental Agreement by Renter or Additional Driver;
(l) Single vehicle roll-over. A roll over is defined as a vehicle sustaining all types of damage due to it not being on all 4 wheels; (the vehicle being on its side is construed as a roll over) Single vehicle accidents are included in all liability cover options, except in the case of roll-overs.
(m) Double standard excess apply to single vehicle accidents. Standard cover excess = ZAR 30, 000.00 x 2 = ZAR 60, 000.00 (Repairs less than ZAR 60, 000.00 will be refunded)
(n) Damage caused to equipment such as Canopy, Rooftop tents, Awnings and Fridges.

9.7 Additional waiver cover is available at an additional cost which offers reduced excess for both collision and theft damages.
Tyre and Windscreen damage waiver can be purchased at an additional cost of ZAR 50.00 per day for Tyre damage and ZAR50.00 per day for Windscreen damage.

9.8 WINDSCREEN WAIVER

Cover includes damage to the:

• Windscreen; “Windscreen”: means the glass screen at the front of the Vehicle only and excludes back window side windows, mirrors and lights.)

Upon acceptance of the Windscreen Damage Waiver the Renter agrees to pay the applicable Claims administration amount only in respect of any damage and/ or loss suffered from any cause whatsoever in respect of the Windscreen, subject to the following exclusions, in which event the Renter will be held liable for payment of the full cost of the damage in terms of this Rental Agreement: –

(a) Damaged caused due to Gross Negligence or Intentional Conduct, including speeding (Exceeding the applicable speed limit);
(b) Where damage and/or loss is sustained and or rear window, side windows, mirrors and lights of the Vehicle;
(c) Where the Vehicle was driven in or to a country and/or area, for which written approval was not obtained from the Company;
(d) Where a non-designated driver was driving the vehicle;
(e) Where the damage/loss is sustained as a result of civil unrest, riot, war or political unrest;
(f) In the case of a major accident, the cost of the damage to the windscreen are deemed to be covered under the applicable Standard or Super Waiver (subject to the conditions applicable to Standard and Super Waiver) cover and will form part of the overall cost of the repairs and are not excluded under the Windscreen Waiver;

9.9 A handling fee of ZAR 450.00 is charged on all damage/accident claims irrespective of the liability cover option taken.

10. ROAD RESTRICTIONS

10.1 The Avis Safari Rental 4wd vehicles are allowed on all bitumen/tar and gravel roads as well as all recognized public 4×4 tracks in South Africa, Botswana, Namibia, Lesotho, Zimbabwe, Zambia, Mozambique, Swaziland. Special permission is required for any other countries in Sub Saharan Africa.

11. CROSS BORDER SURCHARGES

11.1 A once off cross-border surcharge is applicable when leaving South African or Namibian borders. This is a once off charge irrespective of how many borders are crossed. See the applicable fees below.
11.2 A once off cross-border surcharge of ZAR 1250.00 is applicable for the countries of Botswana, Namibia, Zimbabwe, Zambia, and Southern Mozambique (south of the Zambezi River). If the vehicles are collected in a neighbouring country and no borders are crossed, then the cross border fee is not applicable but only the delivery surcharges as listed previously. As an example if the vehicle is collected and dropped off in Namibia and no borders are crossed then no cross border fee is applicable.
11.3 Our vehicles may not travel further than Zimbabwe- Harare, Zambia-Lusaka, Botswana-Kasane, Mozambique-Beira.
11.4 No surcharge applicable for Swaziland and Lesotho
11.5 A CO2 emissions charge of ZAR 450.00 for any vehicle picked up or entering Namibia is applicable.
11.6 South Africa road tax in the amount of ZAR 500.00 will be charged per vehicle traveling on South African roads.

12. EQUIPMENT RENTALS

12.1 Additional equipment is available through Avis Safari Rental as non- standard vehicle equipment and in addition to the vehicle rental.
12.2 This includes electronic equipment like GPS and satellite phones. Avis Safari Rental may use outside suppliers for this equipment and cannot warrant the accuracy or reliability of this equipment.
12.3 This equipment should be checked by the Renter on handover to ensure it is fully functional.
12.4 Should the equipment fail during the hire period it should be reported to Avis Safari Rental immediately although we cannot guarantee replacement or repair and this will not constitute a breach of contract or affect the vehicle rental agreement. Avis Safari Rental will endeavour to refund the rental of such equipment from the date reported or authorize replacement at the nearest town centre if feasible.
12.5 Equipment will be tested by the supplier / manufacturer to establish reason for failure and grounds for refund.

13. LICENCE

13.1 A valid unendorsed code B/EB or 08 national or an international driver’s licence in ENGLISH for vehicles less than 3500kg, is required.

14. MINIMUM AGE

14.1 The minimum age permitted to rent is 25 years.
15.2 A surcharge of ZAR 1500-00 for any drivers under the age of 25 years old with a minimum age of 23 that has had a license for a minimum of 3 years.

15. GENERAL

15.1 The Renter is fully responsible for any damage or related costs to the vehicle or third party if;

The terms of the rental contract are breached.
Damage to the vehicle or equipment caused by careless or reckless driving.
Driving under the influence of drugs or alcohol.
Water submersion or salt-water damage.
Suspension Undercarriage damage.
If the vehicle is abandoned and no contact is made by the Renter to Avis Safari Rental.
Driving on restricted or closed roads.
Driving on dunes or off-road where no track is obvious.
Damage to the vehicle due to collision with animals.
AVIS Safari Rental is not responsible for any damage or theft to items of personal nature. Travel and personal insurance is highly recommended.

The incorrect fuel is pumped into the fuel tank and/or fuel in the water tank will incur a ZAR 20,000.00 cost. AVIS Safari rental advises that should this occur, the vehicle is to remain turned off and not started under any circumstances. This reduces the damage caused;
The renter is responsible for any damages or accidents that AVIS Safari Rental has not been made aware of on the return of the vehicle. Please note the applicable charges will be charged to the nominated credit card.
Damage is incurred due to incorrect use of the hand brake;
The damage to the clutch after 5 days of commencement of the rental. The customer is then liable for: The cost of the clutch kit which is ZAR 24,500.00 including VAT and installation;

16. RETURN

When returning the vehicle, please set aside one hour for the vehicle and equipment to be checked on equipped vehicles.

Although we request that the vehicle be returned with a full fuel tank, as a courtesy to the next renter our representatives will take the vehicle to our refuelling station to ensure that the vehicle is full.
Should top-ups be required, the fuel amount will be deducted from the renter’s nominated credit card.
Any vehicles returned later than the agreed return date, or outside of normal office hours (without prior arrangement), will be charged a full day’s rental per calendar day. Rental days lost due to the vehicle being returned before the agreed return date will not be credited.
The company reserves the right to charge for fuel on vehicles that are not returned full, a 3-litre allowance for vehicle movement will be given.

The renter knows and understands that no smoking in the rental vehicles is allowed, and that a fee of ZAR 3,500-00 will be charged to remove any fumes or smells and/or burn marks on the interior of vehicle caused by smoking in the rental vehicle.

17. FORCE MAJEURE

If AVIS Safari Rental is prevented or restricted in any way from carrying out all or any of its obligations under this agreement by reason of Force Majeure (an event or circumstance beyond the control of the parties, such as, but not limited to: war, strike, riot, pandemic, crime, fire, or an Act of God such as flooding, an earthquake, storm or adverse weather conditions, an act of Government or other authority which prevents one or both parties from performing their obligations under this agreement) then AVIS Safari Rental will be relieved of its obligations in terms of this agreement during such period of force majeure.

AVIS Safari Rental will not be liable for any loss, damage, action or claim which may be brought by the Renter or by any other party in consequence of such delay or inability to perform.

AVIS Safari Rental reserves the right to retain any deposits made by the renter for future bookings.
